Records

Section 5 of Schedule 2 establishes that records maintained by the Secretary of State in connection with the HGV Road User Levy can be used as evidence in legal proceedings.

• A statement from the Secretary of State's records is admissible as evidence in any legal proceedings, to the same extent as oral evidence, provided it relates to prescribed matters.
• The statement must come from (or purport to come from) the official records maintained under the Act, a copy of those records, or a note of information contained in them.
• The document containing the statement must be authenticated by a person authorised by the Secretary of State.
• "Document" is defined broadly as anything in which information is recorded, and "copy" includes information copied by any means, whether directly or indirectly.
