HGV Road User Levy Act 2013 section 16

Power to install equipment for detection of offences under section 11

Section 16 extends existing powers to install roadside detection equipment so that it can also be used to detect HGV road user levy offences across England, Wales, Scotland and Northern Ireland.

  • Highway and roads authorities already had the power to install equipment on roads to detect traffic offences — this section widens that power to include detection of HGV levy non-payment offences.
  • The amendments apply to the Highways Act 1980 (England and Wales), the Roads (Scotland) Act 1984, and the Roads (Northern Ireland) Order 1993, ensuring UK-wide coverage.
  • The specific offence targeted is under section 11 of the HGV Road User Levy Act 2013: using or keeping a heavy goods vehicle on public roads without having paid the required levy.
  • The changes are purely procedural, updating the wording and headings in existing road legislation to add HGV levy offences alongside the traffic offences already covered.
