Meaning of "settlor"

Paragraph 12 of Schedule 4A establishes how the term "settlor" is to be defined for the purposes of the schedule dealing with disposals of interests in settled property and the deemed disposal of underlying assets.

  • The definition of "settlor" for Schedule 4A is imported from paragraphs 7 and 8 of Schedule 5 to the same Act
  • A person is a settlor if the settled property consists of or includes property originating from that person
  • Property originates from a person where it is property provided by that person
  • The same definition of "settlor" that applies for section 86 (attribution of gains to settlors with interests in non-resident settlements) also applies for Schedule 4A purposes
