Interpretation of Schedule

Schedule 8B paragraph 3 defines the key terms used throughout the Schedule relating to social investment tax relief and the deferral of chargeable gains.

  • The "amount invested" is the consideration given by the investor when acquiring the social investment, in cases where the Schedule applies under paragraph 1.
  • The "investor" is the individual who made the chargeable gain and invested in the qualifying social enterprise, as identified under paragraph 1 or paragraph 2.
  • The "original gain" is the chargeable gain that the investor is seeking to defer by making the qualifying social investment, as referred to in paragraph 1 or paragraph 2.
  • A "disposal within marriage or civil partnership" is a no-gain, no-loss transfer between spouses or civil partners under section 58 of the Act.
