Periods that do not count

Schedule 5BA paragraph 4 identifies periods of share ownership that are excluded when determining whether the qualifying holding period conditions for entrepreneurs' relief have been met.

  • Certain periods during which shares are held do not count towards the qualifying ownership period required for entrepreneurs' relief purposes.
  • The provision ensures that only genuine periods of qualifying ownership are taken into account when testing whether the minimum holding period has been satisfied.
  • This prevents taxpayers from including periods where the underlying conditions for relief were not actually met, even though the shares were technically held throughout.
