Residence of companies

Section 286A ensures that the same rules used to determine where a company is resident for corporation tax purposes also apply when determining company residence for capital gains tax purposes.

  • The rules for determining company residence are found in Chapter 3 of Part 2 of the Corporation Tax Act 2009.
  • These residence rules apply to the Taxation of Chargeable Gains Act 1992 so far as it relates to capital gains tax.
  • The same rules also apply to any other legislation relating to capital gains tax.
  • The effect is that company residence is determined on a consistent basis across both corporation tax and capital gains tax.
