Exclusion of double relief

Section 164M prevented taxpayers from claiming more than one form of tax relief on the same chargeable gain under the rollover relief provisions of Chapter 1A.

  • Section 164M was part of Chapter 1A (sections 164Aโ€“164N), which provided a rollover relief regime for chargeable gains.
  • The section ensured that where relief was available under more than one provision, the same gain could not benefit from overlapping or duplicated relief.
  • The entire Chapter 1A, including section 164M, was repealed by the Finance Act 1998 for acquisitions made on or after 6 April 1998.
  • Any transactions completed before 6 April 1998 may still be governed by the original Chapter 1A provisions, including this anti-double-relief rule.
