Qualifying trades

Section 164I defined which trades qualified for the purposes of the roll-over relief provisions formerly available under Chapter 1A of the Act, before these rules were repealed.

  • Section 164I set out the criteria that a trade had to meet in order to be considered a "qualifying trade" for the purposes of the roll-over relief on reinvestment that was available under sections 164A to 164N.
  • The qualifying trade requirements were designed to ensure that the relief was directed towards genuine commercial trading activities rather than passive investment or certain excluded types of business.
  • The entire Chapter 1A, which included sections 164A through to 164N, was repealed by the Finance Act 1998 and ceased to have effect for acquisitions of assets made on or after 6 April 1998.
  • For any acquisitions made before 6 April 1998, the original provisions (including the qualifying trade definition in section 164I) would still be relevant to claims already in progress or under review.
