Restriction applying to retirement relief and roll-over relief on re-investment

Section 164C imposed a restriction preventing taxpayers from claiming both retirement relief and roll-over relief on re-investment in respect of the same chargeable gain.

  • Section 164C was part of a set of provisions (sections 164Aโ€“164N) dealing with roll-over relief where proceeds from the disposal of a qualifying asset were re-invested in another qualifying asset
  • The section prevented double relief by restricting the availability of roll-over relief on re-investment where retirement relief had already been claimed against the same gain
  • The entire Chapter 1A, including section 164C, was repealed by the Finance Act 1998 for acquisitions made on or after 6 April 1998
  • For any disposals and re-investments that took place before 6 April 1998, the restriction would still have applied under the law as it then stood
