Taxation of Chargeable Gains Act 1992 Schedule 2 paragraph 22

Spouses and civil partners

Schedule 2 paragraph 22 previously dealt with rules relating to the transfer of assets between spouses and civil partners for the purposes of calculating chargeable gains, but this provision has been repealed.

  • This paragraph originally addressed the capital gains tax treatment of asset transfers between spouses and civil partners.
  • The provision was amended in 2005 by the Tax and Civil Partnership Regulations to extend its scope to include civil partners alongside spouses.
  • The entire paragraph was subsequently repealed by the Finance Act 2008, Schedule 2, paragraph 57.
  • Practitioners should refer to the current provisions of the Taxation of Chargeable Gains Act 1992 for the rules now governing transfers between spouses and civil partners.
