Taxation of Chargeable Gains Act 1992 section 14D

Persons chargeable to capital gains tax on NRCGT gains

Section 14D identifies which persons are liable to capital gains tax on non-resident capital gains tax (NRCGT) gains arising from disposals of UK property interests.

  • NRCGT gains are chargeable gains arising to non-UK residents on disposals of interests in UK land or property.
  • The section establishes the category of persons who fall within the charge to capital gains tax specifically in respect of these NRCGT gains.
  • The provision was amended by Finance Act 2019, Schedule 1, paragraph 2, reflecting the extension of the NRCGT regime.
  • The rules ensure that non-resident persons disposing of UK property interests are brought within the UK tax charge on any resulting gains.
