Exclusion of some alternative finance return from sale consideration

Section 151X ensures that the alternative finance return element is stripped out when calculating the sale or purchase consideration of an asset for capital gains tax purposes under three types of alternative finance arrangement.

  • Where an asset is sold under purchase and resale arrangements, the alternative finance return is excluded from the sale and purchase consideration for CGT purposes (with specific provision made separately under section 151J).
  • Where an asset is sold under diminishing shared ownership arrangements, the alternative finance return is similarly excluded from the consideration for CGT purposes (with specific provision made separately under sections 151K and 151KA).
  • Where an asset is sold under investment bond arrangements, the alternative finance return is again excluded from the consideration for CGT purposes (with specific provision made separately under section 151N).
  • The exclusion does not override any other provision in the Taxation of Chargeable Gains Act or the Tax Acts that substitutes a deemed amount of consideration in place of the actual consideration.
