The responsible members of an NRCGT group

Section 188H identified which members of a non-resident capital gains tax (NRCGT) group were responsible for meeting the group's tax obligations in relation to UK property disposals. This section has now been repealed.

  • Section 188H was part of a set of provisions (sections 188Aโ€“188K) introduced by Finance Act 2015 to deal with capital gains tax on disposals of UK property by non-resident groups of companies, effective from 6 April 2015.
  • The section established which members within an NRCGT group bore responsibility for the group's compliance and payment obligations when UK property gains arose.
  • The entire set of NRCGT group provisions (sections 188Aโ€“188K) was repealed by Finance Act 2019 as part of a broader reform of how non-UK residents are taxed on gains from UK property.
  • The repeal took effect for capital gains tax purposes from the 2019โ€“20 tax year onwards, and for corporation tax purposes for accounting periods beginning on or after 6 April 2019.
