Functions transferred to Treasury

Section 49 transfers responsibility for child benefit and guardian's allowance from the Secretary of State (for Great Britain) and the Northern Ireland Department to the Treasury.

  • The Treasury takes over responsibility for guardian's allowance in both Great Britain and Northern Ireland.
  • The Treasury takes over responsibility for child benefit in both Great Britain and Northern Ireland, with minor exceptions relating to certain scheduling provisions.
  • Powers dealing with overlap between child benefit or guardian's allowance and benefits under other member states' legislation are also transferred to the Treasury.
  • Functions relating to the review and alteration of child benefit and guardian's allowance rates are likewise transferred to the Treasury in both Great Britain and Northern Ireland.
