Conditions for allowances

Section 108 modifies the conditions for contribution allowances where contributions were made before 27th July 1989, by disapplying certain requirements that would otherwise need to be met.

  • This provision applies only to contributions made before 27th July 1989
  • It modifies how section 536(5) operates when applied for the purposes of section 537(2), which sets out conditions for contribution allowances
  • Two specific requirements are disapplied: paragraph (a)(iv) and paragraph (b) of section 536(5)
  • The effect is that contributors who made payments before that date face fewer conditions to satisfy in order to qualify for contribution allowances
