Meaning of "development" etc.

Section 436 defines the planning-related terms used in this part of the Act by referring to the appropriate planning legislation for each UK jurisdiction.

  • The terms "development", "development order", "general development order" and "planning permission" all take their meanings from the relevant planning legislation
  • For land in England or Wales, the definitions come from section 336(1) of the Town and Country Planning Act 1990
  • For land in Scotland, the definitions come from section 277(1) of the Town and Country Planning (Scotland) Act 1997
  • For land in Northern Ireland, the definitions come from section 250(1) of the Planning Act (Northern Ireland) 2011
