Capital Allowances Act 2001 Schedule 3 paragraph 92

Scope of paragraphs 93 to 101

Paragraph 92 defines the scope of the transitional rules in paragraphs 93 to 101, which preserve the old regime for capital expenditure on purchasing patent rights incurred before 1st April 1986.

  • Paragraphs 93 to 101 apply specifically to capital expenditure on purchasing patent rights incurred before 1st April 1986.
  • The modern rules in Chapters 2 to 4 of Part 8 of the Capital Allowances Act 2001 do not apply to this pre-April 1986 expenditure.
  • Certain specific provisions from the modern rules are carried across by paragraph 101, but otherwise the old regime is preserved intact.
  • This creates a self-contained set of transitional rules governing allowances and charges for anyone still holding patent rights purchased before 1st April 1986.
