Capital Allowances Act 2001 section 104AA

Meaning of "main rate car"

Section 104AA defines what qualifies as a "main rate car" for the purposes of capital allowances on plant and machinery, determining which cars attract the main rate of writing down allowance rather than the special (lower) rate.

  • A main rate car is one that was first registered before 1 March 2001, has low COโ‚‚ emissions, or is electrically propelled
  • A car has low COโ‚‚ emissions if it was registered on the basis of a qualifying emissions certificate and its COโ‚‚ emissions do not exceed 50 grams per kilometre driven
  • The Treasury has the power to amend the 50g/km COโ‚‚ emissions threshold by order, and any such order may include transitional provisions
  • Key terms such as "car", "electrically propelled", "applicable COโ‚‚ emissions figure" and "qualifying emissions certificate" are defined elsewhere in the Act
