Capital Allowances Act 2001 section 270HB

UK property businesses and overseas property businesses

Section 270HB explains how structures and buildings allowances are given effect when the qualifying activity is a UK property business or an overseas property business.

  • Applies where a person is entitled to a structures and buildings allowance for a chargeable period
  • Covers qualifying activities that consist of either a UK property business or an overseas property business
  • The allowance is treated as an expense of that property business for the purposes of calculating profits
  • This mechanism ensures the allowance reduces taxable property business profits in the same way as any other deductible expense
