Capital Allowances Act 2001 section 500

The relevant interest in the dwelling-house

Section 500 defines how the relevant interest in a dwelling-house that forms part of a larger building is determined.

  • Where a dwelling-house is contained within a larger building, the relevant interest in that dwelling-house derives from the relevant interest in the building as a whole.
  • The relevant interest in the dwelling-house is limited to the extent that the overall building interest applies to the dwelling-house portion.
  • This means you do not need to identify a separate or different type of interest for the dwelling-house โ€” it follows from the building's relevant interest.
  • This provision ensures consistency between the treatment of the building and any dwelling-house comprised within it for capital allowances purposes.
