Transitional provisions: continuity of previous actions

Schedule 4 paragraph 2 ensures that actions taken under the old laws that were replaced by the 1994 Act continue to have legal effect under the corresponding provisions of the new Act.

  • Any action validly carried out under the previous vehicle excise legislation continues to have effect as if it had been done under the equivalent provision of the 1994 Act.
  • This continuity applies broadly, including to subordinate legislation (such as statutory instruments and orders) made under the old laws.
  • Vehicle licences issued under the repealed or revoked provisions are similarly treated as having been issued under the new Act.
  • There is one specific exclusion: the Vehicle Licences (Duration and Rate of Duty) Order 1980 is not carried forward under this transitional provision.
