Orders

Section 60 sets out the parliamentary procedures that apply when the Secretary of State makes orders under the Vehicle Excise and Registration Act 1994.

  • All orders made by the Secretary of State under this Act must be made by statutory instrument.
  • Orders relating to licence duration, island goods vehicles, and transitional trade licence provisions are subject to the negative resolution procedure โ€” they take effect unless Parliament votes to annul them.
  • Orders relating to exemptions for foreign vehicles and certain recovery vehicle duty provisions require the affirmative resolution procedure โ€” a draft must be approved by both Houses of Parliament before the order can be made.
  • The distinction between the two procedures reflects the relative significance of the powers: more substantive changes require active parliamentary approval, while routine matters proceed unless Parliament objects.
