Assignment of registration marks

Schedule 4 paragraph 11 clarifies that certain provisions in the 1994 Act about trade licence registration marks do not retroactively change the law as it stood before 27 July 1989.

  • Section 23 of the 1994 Act contains provisions about trade licences and the assignment of temporary registration marks to vehicles used under those licences.
  • Some of these provisions originated from amendments made by section 10 of the Finance Act 1989, which changed the earlier Vehicles (Excise) Act 1971.
  • Paragraph 11 ensures that incorporating those 1989 amendments into the consolidated 1994 Act does not retrospectively alter how the earlier legislation (the 1971 Act or the corresponding Northern Ireland 1972 Act) operated before 27 July 1989.
  • In practice, any matters governed by the old legislation or regulations made under it, relating to periods before 27 July 1989, remain unaffected by the way the 1994 Act is worded.
