Disputes

Paragraph 8 of Schedule 2A provides for how disputes arising from the regulations may be resolved, including the courts that may hear them and the remedies available.

  • The regulations may set out the procedures to be followed when a dispute arises under the regulations.
  • A dispute may be brought before a magistrates' court in England and Wales, or a court of summary jurisdiction in Northern Ireland.
  • The court has the power to order the Secretary of State to pay a sum of money to the claimant.
  • The provision covers both the process for making an application and the types of orders the court may make.
