Paragraph 4 โ€“ Reading old references as references to the new Act

Paragraph 4 of schedule 4 explains how references in other legislation or documents to provisions that were repealed or revoked by the 1994 Act should be interpreted going forward.

  • Where any law, legal instrument, or document refers to a provision that has been repealed or revoked by the Vehicle Excise and Registration Act 1994, that reference should generally be read as referring to the equivalent provision in the 1994 Act.
  • This applies to both express (explicitly stated) and implied references in existing materials.
  • The re-reading of old references applies only in relation to times, circumstances, and purposes arising after the 1994 Act came into force.
  • The rule applies only so far as the context permits โ€” meaning it will not override situations where the context clearly requires the old provision to be understood in its original form.
