Paragraph 30 of schedule 3 updates cross-references in the Criminal Justice Act 1991 so that its definition of "fine" refers to the correct penalty and additional liability provisions of the Vehicle Excise and Registration Act 1994, replacing the old references to the Vehicles (Excise) Act 1971.

  • The definition of "fine" in section 24(4) of the Criminal Justice Act 1991 is amended to reflect the consolidation of vehicle excise law into the 1994 Act.
  • References to penalties under sections 8(1) and 18(4) of the Vehicles (Excise) Act 1971 are replaced with references to sections 29 and 37 of the 1994 Act, which deal with penalties for using or keeping an unlicensed vehicle and for not paying duty at the higher rate.
  • References to additional liabilities under sections 9, 18A, and 26A of the 1971 Act are replaced with references to sections 30, 36, and 38 of the 1994 Act, covering additional liability for keepers of unlicensed vehicles, failed payment additional liability, and additional liability for vehicles chargeable at a higher rate.
  • This is a purely consequential amendment โ€” it does not change the substance of the law but simply ensures that the Criminal Justice Act 1991 points to the correct, up-to-date legislation.
