Duty to give information: offences under regulations

Section 46A gives the Secretary of State the power to require information from people who have failed to comply with vehicle registration regulations, and makes it a criminal offence not to respond to such a notice.

  • Where someone involved in the sale or disposal of a vehicle has failed to provide prescribed particulars or documents under the registration regulations, or where someone surrendering, not renewing, or not holding a vehicle licence has failed to furnish required particulars or declarations, the Secretary of State may intervene.
  • The Secretary of State may serve a notice on that person requiring them to provide any information within their power regarding who is keeping or has kept a specified vehicle, who has sold or disposed of it, or any information that may help identify such persons.
  • Failure to comply with such a notice is a criminal offence.
  • The penalty on summary conviction is a fine not exceeding level 3 on the standard scale.
