The Road Traffic Offenders Act 1988

Paragraph 25 of Schedule 3 updates the Road Traffic Offenders Act 1988 to replace references to the old Vehicles (Excise) Act 1971 with references to the Vehicle Excise and Registration Act 1994, and adds certain vehicle excise offences to Schedule 3 of that Act.

  • References to the Vehicles (Excise) Act 1971 in sections 71(9)(b), 85(5) and 89(2)(c) of the Road Traffic Offenders Act 1988 are replaced with references to the Vehicle Excise and Registration Act 1994.
  • Three vehicle excise offences are added to Schedule 3 of the Road Traffic Offenders Act 1988.
  • The offences added relate to not displaying a vehicle excise licence (section 33), driving or keeping a vehicle without the required registration mark (section 42), and driving or keeping a vehicle with an obscured registration mark (section 43).
  • These are consequential amendments ensuring that the road traffic offenders framework properly cross-references the new 1994 Act rather than the repealed 1971 Act.
