Records

Section 52 establishes that official records maintained by the Secretary of State in connection with vehicle excise and registration can be used as evidence in legal proceedings.

  • Statements from the Secretary of State's vehicle registration and excise records are admissible as evidence in any legal proceedings, covering facts on matters specified by regulations.
  • The records must be authenticated by a person authorised by the Secretary of State, and may take the form of original records, copies, or notes of information from those records.
  • The definitions of "document", "copy", and "statement" are broad โ€” a document is anything in which information is recorded, a copy is anything onto which that information has been reproduced by any means, and a statement is any representation of fact however made.
  • The evidential provisions apply to both civil and criminal proceedings across England, Wales, and Scotland.
