Immobilisation

Schedule 2A paragraph 1 sets out the powers available to authorised persons to immobilise (clamp) vehicles suspected of being used or kept without a valid vehicle licence, and the conditions under which those vehicles may be released.

  • An authorised person who believes a vehicle is being kept or used without a valid licence may clamp it or move it and clamp it elsewhere, provided the vehicle is not on land associated with a dwelling
  • A notice must be fixed to the clamped vehicle warning against moving it, explaining the steps needed for release, and providing other prescribed information
  • The vehicle may be released once a prescribed release charge is paid and the owner either proves the vehicle was properly licensed or declared off-road, pays a prescribed sum, or meets other prescribed conditions
  • Vehicles displaying a valid disabled person's badge are exempt from immobilisation, and the immobilisation notice must not be removed or interfered with except by an authorised person
