Authorised persons

Section 49 deals with who may represent the Secretary of State in court proceedings under the Vehicle Excise and Registration Act 1994.

  • The Secretary of State may authorise a person to conduct and appear in legal proceedings on their behalf under this Act.
  • In England and Wales, such authorised persons may appear in a magistrates' court or the county court.
  • In Scotland, they may appear in any court other than the High Court of Justiciary or the Court of Session.
  • In Northern Ireland, they may appear in a court of summary jurisdiction or before a county court.
