Interpreting references to provisions of the Act in relation to earlier legislation

Schedule 4 paragraph 3 explains how references to provisions of the 1994 Act should be understood when dealing with periods before the Act came into force, by treating them as references to the corresponding earlier provisions that the Act replaced.

  • Where any legislation, legal instrument or document refers to a provision of the Vehicle Excise and Registration Act 1994, that reference can also be read as including the corresponding older provision that the 1994 Act repealed or revoked.
  • This applies to both express (explicitly stated) and implied references to the Act's provisions.
  • The rule operates in relation to times, circumstances and purposes that arose before the 1994 Act commenced.
